Terms and Conditions for Founding Gardener
Last updated: 29 October 2026
This is a translation for your convenience. Where the German version and this translation differ, the German version applies.
1. Scope and seller
These terms apply to purchasing "Founding Gardener" via soulgarden.app. Your contractual partner is Actualize Me!, owner Oliver Braese, Hauptstraße 167, 67827 Becherbach, Germany, email: hello@soulgarden.app ("we").
The SoulGarden app itself is free and will stay free. Founding Gardener is a voluntary purchase and not required to use SoulGarden.
2. What Founding Gardener includes
Founding Gardener is a one-time purchase, not a subscription. It includes:
- Access to all SoulGarden premium features at no further cost, for as long as we operate SoulGarden. Premium features are being built step by step. As currently planned, they include the meditation configurator, your own meditations and a garden the way you like it with 100 instead of 15 stages. There is no entitlement to specific features or dates.
- A personal meditation recorded for you by Oliver Braese. We agree on the topic and process with you by email. If you agree, we later add it to the app's library without any personal references.
- A Founding item in the app's garden that only Founding Gardeners receive.
- If you wish, your name or a name of your choice on soulgarden.app and in the app's credits. You can withdraw this at any time.
- For the first 100 Founding Gardeners: a say in how SoulGarden grows. We ask about your wishes and invite you to vote on new features and meditations. Votes are advisory; the decision stays with us.
3. Activation
We activate Founding Gardener for the SoulGarden account that belongs to the email address you enter at checkout. If you use a different address in the app, just write to hello@soulgarden.app. Founding Gardener applies to one account.
4. Conclusion of the contract
The presentation on our website is not yet a binding offer. The "Become a Founding Gardener" button takes you to the checkout page of our payment provider Stripe, where you enter your details and can review and correct them before submitting.
By clicking the pay button you make a binding offer. The contract is concluded as soon as the payment is confirmed. You then receive a confirmation by email.
The contract languages are German and English. We do not store the contract text separately. You can open, save and print these terms on this page at any time.
5. Price and payment
Founding Gardener costs a one-time 39 € for the first 100 buyers and then 49 € up to the 1,000th Founding Gardener. The price shown at checkout applies. There are no further costs.
Under Section 19 of the German VAT Act (small business regulation), no VAT is charged.
You pay via Stripe using one of the payment methods offered there, for example credit card or PayPal. The price is due immediately.
6. 30-day money-back
Independently of your statutory right of withdrawal, we refund the full price within 30 days of purchase without you having to give reasons. An email to hello@soulgarden.app is enough. Founding Gardener ends with the refund. This voluntary promise does not affect your statutory rights.
7. Right of withdrawal
As a consumer you have a statutory 14-day right of withdrawal. Details and the withdrawal function are in our withdrawal policy at soulgarden.app/en/withdrawal.
8. Availability
We do our best to keep SoulGarden available at all times. Maintenance, updates or disruptions may temporarily limit access.
Should we permanently discontinue SoulGarden, we will announce this by email at least three months in advance.
9. Rights of use
Meditations, images, animations and texts in SoulGarden are protected by copyright. You receive a simple, non-transferable right to use them for yourself.
10. Defects
The statutory provisions for digital products apply (Sections 327 et seq. of the German Civil Code).
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence we are only liable if we breach an essential contractual obligation, and then limited to the foreseeable, typical damage.
SoulGarden accompanies you while meditating. It is not a substitute for medical or psychotherapeutic treatment.
12. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, just write to hello@soulgarden.app.
13. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country you live in remain unaffected.
Should any provision of these terms be invalid, the rest of the contract remains valid.
